End user licence agreement

This agreement is between you (or the organisation you act for) and Steady Circuit Ltd, trading as SteadyCircuit, registered in England & Wales under company number 16471673, with its registered office at 66 Paul Street, London, EC2A 4NA (“we”, “us”), and it governs your use of the SteadyMonitor service, dashboard and monitoring agent. By signing in or by installing an agent, you accept it. If you do not accept it, do not use the service.

1. What you may do

We grant you a non-exclusive, non-transferable, revocable licence to use SteadyMonitor for your own monitoring, and to install and run as many copies of the agent as your plan allows, on infrastructure you control. The licence lasts as long as your account is in good standing.

2. What you may not do

• Monitor anything you are not entitled to monitor. You may only point checks at systems you own or have permission to test. A monitor is a repeating, automated request: aimed at somebody else's system without their agreement, it is at best a nuisance and may be unlawful. This is the term we enforce most readily.
• Use the service to attack, overload, probe or disrupt anyone, or to disguise the origin of traffic that does.
• Set an interval or a volume of checks intended to exhaust a target's capacity rather than to observe it.
• Resell, sublicense or offer the service to third parties as your own, unless we have agreed that in writing.
• Attempt to access another workspace's data, or to circumvent the limits, rate limiting or authentication in the service.
• Remove or obscure any notice of ownership or licensing in the software.

3. Your account and your agents

You are responsible for what happens under your account, for keeping your agent tokens secret, and for the machines you install agents on. An agent token authenticates as your workspace: if one leaks, remove that agent from the dashboard. You are responsible for the security and lawfulness of anything your checks send to your own systems.

4. What we provide, and what we do not promise

We work to keep SteadyMonitor available and accurate, but it is provided as it is. We do not warrant that it will be uninterrupted, that every check will run at the exact moment it is due, that every alert will be delivered, or that it will detect every outage. Alert delivery in particular depends on services we do not control, including Telegram, email providers and your own network.

Do not make SteadyMonitor your only safeguard. If an outage would cause you serious loss, keep an independent means of detecting it. Monitoring tells you what it observed from where its agents sit; it cannot promise to observe everything.

5. Availability, changes and fees

We may change, add to or withdraw features. Where a change materially reduces what you have paid for, we will tell you in advance. Any fees and billing periods are those agreed with you directly.

We give no service level commitment. SteadyMonitor is provided on a best-effort basis: we do not promise a percentage of uptime, a response time, or a time to fix, and no credit or refund is due if the service is unavailable. Section 4 applies in full.

6. Suspension and termination

You may stop using the service at any time. We may suspend or terminate an account that breaches section 2, that is not paid for, or that we are required to suspend by law — immediately where the breach is causing harm to someone else, and otherwise on notice with a chance to put it right. On termination your licence ends, your checks stop, and your data is deleted in accordance with the privacy policy. Export anything you want to keep before you close your account.

7. Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for lost profits, lost revenue, lost data or indirect or consequential loss, and our total liability to you for all claims is limited to the amount you have paid us in the twelve months before the claim arose. Where you have paid us nothing in that period, our liability is limited to nothing.

8. Third-party components

SteadyMonitor is built on open source software, each part under its own licence. Those licences govern those components and nothing in this agreement restricts the rights they give you. They are listed on the attributions page.

9. Changes to this agreement

We may update this agreement. We will update the date at the top and tell you before a material change takes effect; continuing to use the service after that means you accept it.

10. Governing law

This agreement is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
